5 State and Federal Training Mandates
There are five topics that physicians and their staff must receive training on regularly per state and federal requirements, and the TMA Education Center offers programs to meet those mandates.
All these programs are free to members and their staff as a benefit of membership, saving members $200 or more per program or more than $2,000 combined. Find them in the TMA Education Center under the Opioid and Mandated Trainings topics.
State:
- Human trafficking: Meets all required Texas Health and Human Services Commission (HHSC) Human Trafficking Training Standards, is approved by HHSC in accordance with House Bill 2059 (2019), and addresses how to recognize, screen for, and report suspected human trafficking.
- Pain management and the prescribing and monitoring of controlled substances required by the Texas Medical Board: State requirement for a total of 2 hours of formal CME that count as ethics credit and addresses:
- Best practices, alternative treatment options, and multimodal approaches to pain management that may include physical therapy, psychotherapy, and other treatments;
- Safe and effective pain management related to the prescription of opioids and other controlled substances, including education regarding standards of care; identification of drug-seeking behavior in patients; and effectively communicating with patients about the prescription of an opioid or other controlled substances; and
- Prescribing and monitoring of controlled substances.
Federal:
- OSHA: Federal requirement for annual training for all health care workers.
- Treatment and management of patients with opioid or other substance use disorders required for all U.S. DEA-registered practitioners: Federal requirement, one-time 8 hours of specified training.
Federal and state:
- HIPAA and Texas medical privacy laws: Federal and state requirements annually, regularly, and/or within 90 days of hiring.

MGMA, Update on the Court Cases Involving CoVid-19 Vaccination Mandates.

“I wanted to provide a quick update on the court cases involving the COVID-19 vaccination mandates. As many of you have seen, both the OSHA vaccination and testing emergency temporary standard (ETS) and the CMS facilities vaccination mandate were quickly challenged in court. Below is a quick overview of where the mandates currently stand – this is subject to change:
- OSHA vaccination and testing ETS: On Nov. 12, 2021, the U.S. Circuit Court of Appeals for the Fifth Circuit granted a motion to stay (or halt) the ETS. After that decision, OSHA suspended enforcement pending future developments in the litigation. More information about OSHA’s announcement can be found on the ETS landing page. The U.S. Court of Appeals for the Sixth Circuit now has jurisdiction over the challenges and will issue its decision. However, it is certainly possible that following the Court’s ruling, the decision could get appealed to the U.S. Supreme Court.
- CMS facilities vaccination mandate: On Nov. 30, 2021, the U.S. District Court for the Western District of Louisiana issued a preliminary injunction halting the mandate. The ruling comes one day after the U.S. District Court for the Eastern District of Missouri halted implementation of the rule for 10 states. Together, the decisions apply to all states. However, this decision is likely to get appealed as well.
MGMA will continue to monitor this evolving situation and provide updates.”

Subject: OSHA announces new COVID-19 temporary emergency standard for healthcare settings
Good afternoon MGMA members,
Last week, the Occupational Safety and Health Administration (OSHA) issued a COVID-19 emergency temporary standard (ETS) with implications for health care employers. The landing page for the ETS can be found here and the fact sheet can be found here. Once the rule is published in the Federal Register, the compliance deadline for most provisions is within 14 days and within 30 days for the rest.
Some of the requirements in the ETS include:
- developing a “COVID-19 plan” that includes a workplace-specific hazard assessment
- cleaning and disinfection guidelines
- health screening and medical management protocols, and
- physical distance and physical barrier guidelines.
For the full list of requirements under the ETS, see the rule. Certain requirements are waived if workers are vaccinated and are in well-defined areas where there is no reasonable expectation that a person with suspected or confirmed COVID-19 will be present. For more information, see the FAQ.

The Centers for Disease Control and Prevention (CDC) has issued new guidance relating to recommended precautions for people who are fully vaccinated, which is applicable to activities outside of healthcare and a few other environments. OSHA is reviewing the recent CDC guidance and will update our materials on this website accordingly. Until those updates are complete, please refer to the CDC guidance for information on measures appropriate to protect fully vaccinated workers.
